Andrei Komlik-Yamatin, REP leader at MMZ, detained

On October 28, at about 9 a.m., Andrei Komlik-Yamatin, the chairman of the primary organization of the REP Trade Union at the Minsk Engine Plant (known as MMZ), was detained at the entrance to the enterprise. Before that, he was familiarized with an order on his dismissal.

Igor Komlik, the head of the Minsk city REP organization, said that his son was taken to the Partizanskiy RUVD (District Interior Department) of Minsk: “When he learnt about his dismissal, Andrei went to his workplace to take his personal belongings; and on the way back, policemen were already waiting for him. I was informed that the case against Andrei was initiated under Article 23.34 of the Code of Administrative Offences.

This dismissal is completely illegal, same as the detention.

Andrei was fired because, as the chairman of the primary trade union organization, he asked to be allowed into the territory of the enterprise in his free time and to be able to communicate with members of the trade union. But the employer refused to do it, and, moreover, accused him of being in the territory illegally and violating the internal regulations. Naturally, these are the formal reasons for the suppressing workers and trade unionists.

Earlier, Andrei Komlik-Yamatin submitted an application to the bosses of his company that he was going on strike since October 26, since Belarusian authorities had violated the constitutional norms and the international legal acts ratified by Belarus.

Article 23.34. Violation of the procedure for organizing or holding mass events:

1. A violation of the established procedure for holding a meeting, rally, street march, demonstration, picketing, or other mass event, committed by a participant in such events, as well as public calls for organizing or holding a meeting, rally, street march, demonstration, picketing, or other mass event in violation of the established procedure for organizing or conducting thereof, committed by a participant in such events or by another person, if there is no corpus delicti in these actions, shall entail a warning, or the imposition of a fine in the amount of up to thirty basic units, or an administrative arrest.

2. A violation of the established procedure for organizing or holding a meeting, rally, street march, demonstration, picketing, or other mass event, as well as public calls for organizing or holding a meeting, rally, street march, demonstration, picketing, or other mass event in violation of the established order of organizing or holding thereof, if there is no corpus delicti in these actions, committed by the organizer of such events, shall entail the imposition of a fine in the amount of twenty to forty basic units or administrative arrest, and on a legal entity - from twenty to one hundred basic units.

3. The actions envisioned by Part 1 of this Article, committed repeatedly within one year after the imposition of an administrative penalty for the same violations, shall entail the imposition of a fine in the amount of twenty to fifty basic units or administrative arrest.

31. The actions envisioned by Part 2 of this Article, committed repeatedly within one year after the imposition of an administrative penalty for such violations, shall entail the imposition of a fine in the amount of twenty to fifty basic units or administrative arrest, and on a legal entity – a fine from twenty to two hundred basic units.
